In the trial that just concluded, the jury unanimously agreed with Qualcomm's contention that it should be paid $1.41 per iPhone relying on three of its patents.

A jury has decided Apple should pay $31 million in damages for infringing on patents for technology owned by mobile chip maker Qualcomm that helps iPhones quickly connect to the internet and extend their battery life.

The verdict Friday in a San Diego federal court follows a two-week trial that pitted two former allies that have become bitter adversaries. The trial is a fragment of a legal battle involving Apple and Qualcomm, which are sparing over who invented some of the technology used for key features in smartphones and other mobile devices.

The stakes will be much larger in another federal trial next month that will determine whether Apple should be required to pay Qualcomm for licensing other technology used in iPhones.

Apple had been paying the licensing fees until it stopped in 2017 and filed a lawsuit alleging that Qualcomm was abusing his dominance of the mobile chip market to gouge smartphone makers for technology that it hadn’t even invented. That trial is scheduled to start April 15.

In the trial that just concluded, the jury unanimously agreed with Qualcomm’s contention that it should be paid $1.41 per iPhone relying on three of its patents. The damages date back to July 6, 2017, when Qualcomm filed its lawsuit, and covers technology used in the iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X.

San Diego-based Qualcomm hailed the verdict as a validation of its technology’s importance to iPhones. “The technologies invented by Qualcomm and others are what made it possible for Apple to enter the market and become so successful so quickly,” said Don Rosenberg, Qualcomm’s general counsel.

Apple expressed disappointment with the decision. “Qualcomm’s ongoing campaign of patent infringement claims is nothing more than an attempt to distract from the larger issues they face with investigations into their business practices in US federal court, and around the world,” the Cupertino, California, company said.

The dispute between Apple and Qualcomm is also part of an antitrust lawsuit that the US Federal Trade Commission filed in 2017. In that case, the FTC alleges that Qualcomm had been abusing its market power in mobile chips for years. The trial concluded in San Jose, California, earlier this year, but the judge still hasn’t ruled.

专题三(中):苹果商标布局,稳坐科技界超级品牌宝座
苹果公司颠覆了世界对智慧型手机的认知,也在一定的程度上改变了科技领域的趋势。续上一篇文章提及苹果重视其品牌效应及科技创新的执著造就它如今科技的龙头地位以及拥有价值连城的无形资产。这一期会从商标的角度探讨苹果。商标是品牌护身符,是企业的无形资产,商标与企业价值息息相关。商标不但代表企业形象,也是客户认知产品服务优劣的最直接方法。客户可通过商标,认知产品或服务的源头,有效的区分品牌,这也是企业与客户最有效的沟通桥梁。因此,企业可通过商标,保护及拥有企业的商誉及口碑。就如同苹果(Apple)這牌子,对苹果公司的忠实粉丝而言它已经不再是简单的一种水果的稱号,而是代表着高端科技、时尚、潮流的品牌及生活品味。

价值连城的商标
根据2017年世界知识产权报告,苹果公司品牌价值大约1540亿美元左右,在智能手机品牌价值中稳坐第一。就如以上所提到的,品牌与商标是息息相关。众所皆知苹果最广为人知的标志莫过于那颗被咬了一口的苹果。 苹果公司重要的商标资产包括:Apple®,3D Touch®,AirMac®,Apple logo®,Apple TV®, FaceTime®, iBook®, iMovie®, iMac®, iMac Pro®, iPad®, iPad Air®, iPad mini®, iPhone®, iPhoto®, iPod®, iPod touch®, iTunes®, Mac®, MacBook®, Siri®, watchOS®, App Store®, iCloud®等等 。
商标品牌会影响企业价值,间接性影响产品的售价与利润。就以苹果与三星为例,前者在福布斯的品牌价值排名第1,后者则是第11名,大约360亿美元。根据Statista 2017报告显示,苹果智慧型手机利润可高达74%,其他品牌的智慧型手机则望尘莫及。商标与品牌价值可以决定产品的价格,所以商标、品牌、产品等等都是环环相扣,都是企业发展不可忽视的原动力。

苹果iPhone商标风波
苹果一路走来在建设品牌的过程中也遇到不少挑战。在此与大家分享iPhone与iPad商标在进入中国市埸的一些波折。


上图为苹果的iPhone与汉王的i-Phone分别注册在商标类别9的子类0901与0907。

2002年,苹果的“iPhone”商标在中国只注册在类别9的子类0901-电子计算机与其外部设备,并运用于计算机硬件、软件等商品上。同时,中国本土汉王科技公司则开始研发智能固话产品,并推出了“e-phone”和“i-phone”等产品。在2004年申请注册“i-phone”商标,而注册的类别则是类别9的子类0907-通讯导航设备包括移动电话。

苹果公司之所以大意失荆州,主要原因是它忽略了中国商标法实施商标子类別制度,只注册大类别9,却罔顾子类别0907,让第三方有机可乘,占领iPhone在中国用于通讯服务的使用权。

2007年,中国市场几乎找不到“iPhone”手机踪影。原因之一便是手机类“i-phone”商标权仅属于汉王科技公司,而“iPhone”商标与“i-phone”商标属于近似商标,因此苹果商标注册无效。2009年,苹果提出了购买汉王的“i-phone”商标,双方以365万美元达成“i-phone”商标转让协议。随后于2009年10月,苹果的“iPhone”手机在中国正式销售。

苹果iPad商标风波
苹果在推出iPad产品进入中国市场时,在知识产权方面遇到重重关卡。2000年,台湾唯冠(Proview)集团取得欧洲与世界其他地区商标权。隔年,唯冠中国子公司,唯冠科技深圳有限公司(Proview Technology Shenzhen Co.)也在中国注册iPad商标并获得商标权。2009年,苹果以5.5万美元购得台湾唯冠国际(Proview International Holdings Ltd.)的iPad全球商标权。但是中国的iPad商标是深圳唯冠所有。因此苹果在沒有iPad商标通行证的情况下,把iPad产品推入中国市埸。深洲唯冠公司正陷入财务危机,手握可套现的王牌,唯冠当然不会错过。深圳唯冠入禀中国法院, 起诉苹果侵犯商标。iPad是苹果移动设备重要的一环,中国则是苹果第二市场,占苹果全利大约16%,2012年下半年的苹果在中国的销量更上升至79亿美元。苹果与唯冠在法庭上正面交锋直至2012年7月, 最后苹果被逼以6000万美元与唯冠达成和解,方能合法用iPad商标,进入中国市场。

以苹果商标纠纷案例,了解到商标与知识产权对企业的重要性。企业要做大做强,必须意识到知识产权的关键性,以及在主要市场作出策略性保护及布局。商标代表企业品牌的形象与价值。商标经營得当,产品与企业价值也会随之提升。所以企业当务之急,就是要为自己的品牌在主要市場进行商标注册,以免重蹈覆辙苹果iPhone与iPad在中国所发生的商标纠纷。
