ProceduresINDONESIA INDUSTRIAL DESIGN APPLICATION 1.Searching This is the first step before an application is made for the registration of a trademark. Although a prior search is optional it helps in determining the existence of previous marks.
2.Application The requirements of an application are:
- A Declaration of Ownership
- Drawings or photo of the design
- A written description of the description design for which protection is sought in the Indonesian Language.
- Design Application Form
- Assignment of Industrial Design
- Certified copy of Design Priority Document, if a priority claim is made.
Incomplete applicants will be given 3 months for rectification, else the application will be deemed withdrawn. An application number and filing date will be issued on submission of the application.
3.Publication Applications will be published for 3 months from the filing date. On request it can be extended to a maximum period of twelve months.
4.Opposition Oppositions are invited during the publication period from concerned parties. A counter statement for the same has to be submitted within 3 months after the date of receipt of notification from the Director General.
5. Substantive Examination A substantive examination will be conducted only during oppositions. Opposition and counter statements are taken into consideration during the examination.
